Chapter 1 General provision
Article 1 (Purpose)
The purpose of this provision is to enact condition and procedure of utilization of all the service ("service" as below) that Korea's「FTA-PASS」 site ("this site" as below) provides, rights of the user and this site, duty, responsibility, and other matter.

Members cannot transfer or grant authority for using the service or other position that is appointed by use agreement or provide it as a mortgage.
Article 18 (compensation for damages)
This site shall not be liable for any damage to members in connection with the services provided free of charge except for criminal acts committed by the site on purpose.
Article 19 (Exemption clause)
Article 20 (A competent court)
In the case where a suit is filed for a dispute occurred by users' using this service, the Seoul Central District Court is set as an exclusive competent court.
Supplementary provision
Article 16 (Ownership of this site)
1. (Enforcement date) This provision starts from 「September 15, 2011」
The copyright of this provision belongs to 「Korea Customs Service」, and illegal reproduction, distribution, transmission, or other infringement of copyright is strictly prohibited.
Under Article 30 of the Personal Information Protection Act, Korea Customs Service protects the personal information of the subject of the information, and in order to process grievance quickly and smoothly, it establishes and releases following personal information management policies.
These policies will be enforced since June 19, 2019.
Article 1 (Purpose of personal information management)
Korea Customs Service manages personal information for the following purpose. The managed personal information is not used for a purpose other than the following, and in the case where the purpose of the use is changed, under Article 18 of 「Personal Information Protection Act」, necessary measures such as obtaining separate consent, etc. will be taken.
1. FTA origin information system (FTA-PASS) member management
· Personal information will be managed with the purpose of management complying with FTA origin management tasks.
2. Civil petitions treatment
· With the purpose of identification of civil petitioners and checking civil appeals, it manages personal information.
Article 2 (Period for which personal information is held and managed)
① Korea Customs Service manages and holds personal information within the period of holding and managing information under legislation or within the period of holding and managing the information which is agreed upon from the subject of the information at the time of personal information gathering.
② Period for which each of personal information is held and managed is as follows
· Title of personal information: FTA origin information system (FTA-PASS) member information
· Holding period: Until the member signs out
Article 3 (Providing a third person with personal information)
① Korea Customs Service manages the personal information of the subject of information within the limit of what is stated in Article 1 (purpose of managing personal information), and the personal information shall be provided to a third party only in the case where it is under article 17 of 「Personal information protection acts」 such as special regulation of the legislation, etc.
② Korea Customs Service provides personal information to third parties as follows:
· Those who receive personal information: the Korea Productivity Center
· The purpose of using personal information of the recipient: FTA PASS customer satisfaction survey
· Provided personal information items: Corporate name, name, rank, phone number, office address
· Period of hold and utilization of the receiving party: destroyed immediately after completing the customer satisfaction survey
Article 4 (Consignment of personal information management)
① For smooth personal information business management, Korea Customs Service is entrusted with management of personal information as follows

· Content of entrusted business: Information system maintenance and management, etc.

②Under Article 25 of 「Personal information protection act」 when concluding the contract of consignment, Korea Customs Service states the items related to responsibilities such as execution purpose of consignment work, prohibition on the management of personal information, technical and administrative action for protection, limit on reconsignment, management and supervision of consignee, compensation for damage, etc.
on the document, and supervises if the consignee is managing personal information safely.
③ In the case where the content of consignment work or consignee is changed, it will be made public through this personal information management policies without delay.
Article 5 ( Rights, Obligation, and exercise method of the subject of information and a legal representative)
① The subject of information can exercise rights such as the request of perusal, modification, deletion, process suspension of personal information, etc. to Korea Customs Service at any time.
② Under Article 41 (1) of 「Enforcement decree of personal information protection act」, the exertion of right under (1) to Korea Customs Service can be carried out through e-mail, FAX, etc., and Korea Customs Service shall immediately take actions against it.
③ The exertion of right under (1) can be carried out through a representative such as a legal representative of the subject of the information or consignee, etc.. In this case, the power of attorney under attached Form 11 of 「Enforcement Rule of personal information protection act」 has to be submitted.
④ Under Article 35 (5) and Article 37 (2) of 「Personal information protection act」, for the request for perusal and process suspension of personal information, the right of the subject of information can be restricted.
⑤ In the case where there is a request of modification and deletion of personal information and the personal information is stated as collection object under other legislation, the request for deletion is not possible.
⑥ Korea Customs Service verifies whether the person who requested perusal, modification, process suspension under the right of a subject of information is the person himself or a lawful representative.
Article 6 (Personal information items managed)
Korea Customs Service manages following personal information items.
1. FTA origin information system (FTA-PASS) member management
· Required items: Representative name, representative phone number, ID, password, name, phone number, e-mail
· Optional items: Rank, department
2. Civil petitions treatment
· Required items: Name and phone number
· Optional items: Rank, department
Article 7 (Destruction of personal information)
① Korea Customs Service destroys corresponding personal information immediately in the case where the personal information is no longer necessary by the expiration of the holding period or achieving the purpose of management of personal information, etc.
②Notwithstanding the expiration of holding period of personal information or achievement of process purpose, in the case where the personal information has to be kept under other legislation, the corresponding personal information (or personal information file) is moved to separate database(DB) or stored in a different storage place.
③ The procedure and method for destroying personal information are as follows.

destroy and destroys it.

· 2. Method of destruction
Korea Customs Service uses methods such as Low Level Format, etc. in order for personal information that is recorded and saved in an electronical file format to not be recycled, and the personal information that is recorded and saved on paper documents is destroyed by pulverizing by pulverizer or incinerating.
Article 8 (Measures to procure personal information safety)
Korea Customs Service takes each of the following items in order to procure security.
1. Administrative measures: Establishment and enforcement of the internal management plan, regular staff training, etc..
2. Technical measure: management of access authority for the personal information management system, encryption of unique identifying information, etc., and installation of a security program
3. Physical measures: access control of computer room, data storage room, etc.
Article 9 ( Items related to establishment, management, and refusal of automatic personal information collection device)
① Korea Customs Service uses a cookie that saves use information and imports it frequently in order to provide users with individually customized service.
②A cookie is a small amount of information that the server(http) that is used for web site management sends to user's computers, and it can also be saved in user's hard disk in his or her computer.
· A. The purpose of using cookie: It is used for providing optimized information for users by comprehending each service and web sites that the user visited and using pattern, popular search word, the status of the secure connection, etc..
· B. Installation, management, and refusal of cookie: Cookie storage can be refused through Tool on the upper side of web browser> Internet option> Options setting of personal information menu
· C. In the case where cookie storage is refused, there can be difficulties using customized service.
Article 10 (Person in charge of personal information protection
Korea Customs Service takes the responsibilities of task relating to the management of personal information altogether and set a person in charge of personal information protection for complaint handling and damage relief of subject of information related to personal information management as follows.

Article 11 (Claim for personal information perusal)
① Under Article 35 of 「Personal information protection act」, the subject of the information can claim for personal information perusal to the following department. Korea Customs Service will endeavor to process the claim for personal information perusal of the subject of the information quickly.

Article 12 (Remedy for infringement on rights and interests)
The subject of information can enquire about damage relief, consultation, etc. regarding infringement of personal information to following institutes.

Also,for the request of the subject of information regarding perusal, modification, deletion, process suspension, etc. of personal information, if his or her right or interest is infringed by the measure or nonperformance executed by a head of public institution, he or she can claim for administrative appeal under Administrative Trial Act.
